Usage of the website www.abstractindianart.com and all other URLs forming part of it (hereinafter referred to as "the Sites"), is governed by these Terms and Conditions of Use. Abstract Indian Art (referred to hereafter as ‘us’ or ‘we’ or ‘Abstract Indian Art’ as the context requires) owns and manages this website through artist Ajay Rajpal creating abstract painting. These Terms and Conditions of Use form the entirety of any express or implied contract that may or may be deemed to exist between you (the user of the Sites) and Abstract Indian Art.

Modification of Terms & Conditions of Use
The right to change these Terms and Conditions of Use under which the Sites are offered is reserved by Abstract Indian Art. This includes, but is not limited to, the charges, if any, that are associated with the use of the sites. The responsibility for regularly reviewing these Terms and Conditions of Use is yours.

Limitation of Personal and Non-Commercial Use
The Sites were designed for a specific intended purpose – selling original abstract paintings in acrylic on canvas and other media created by us. Please ensure that you use them in good faith for this specific intended purpose only. The Sites are for your personal and non-commercial use, unless otherwise indicated. Modification, copying, distribution, transmission, display, performance, reproduction, publishing, licensing, creating derivative works from, transferring, or selling any information, software, products or services obtained from the Sites is strictly prohibited.

Links to other websites may be contained in the Sites (referred to hereafter as ‘Linked Sites’). These Linked Sites are not under the control of Abstract Indian Art. Your name can also be published in connection with your Submission. Abstract Indian Art claims no ownership of the materials provided by you in your Submission. No user identifiable data contained in your Submission will be used or sold by Abstract Indian Art. However, the sole and exclusive right to use, transfer or otherwise deal with compiled user aggregated data in any manner that it deems fit rests with Abstract Indian Art.

Software Available on the Sites
Any software made available to download from the Sites (excluding software made available by end-users through a Communication Service (referred to hereafter as ‘Software’) will remain the copyrighted work of Abstract Indian Art and/or its suppliers. A personal, non-transferable license to use the Software is hereby granted to you (the user) by Abstract Indian Art for no other purpose but to facilitate viewing and otherwise using the particular Site in accordance with these Terms and Conditions of Use. If you have any dissatisfaction with any portion of the Sites, or with any of these Terms and Conditions of Use, discontinuing using the Sites is your sole and exclusive remedy.

Due to Indian custom rules, the artworks are sold on a no return basis.

Termination / Access Restriction
Abstract Indian Art reserves the right to terminate your access to any or all Sites and the related services or any portion thereof at any time, without notice and at its sole discretion.

The laws of India govern all these Terms and Conditions of Use. You hereby consent to the exclusive jurisdiction and venue of the courts in New Delhi, India in any and all disputes arising out of or relating to your use of the Sites. Use of the Sites is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and Abstract Indian Art as superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and Abstract Indian Art with respect to the Sites and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and Abstract Indian Art with respect to the Sites. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form as result of this agreement or use of the Sites. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed.

All trademarks, names, brand names, etc. used on the Sites are either trademarks or registered trademarks of Abstract Indian Art or its associated companies. Any rights not expressly granted herein are reserved.

You hereby agree to abide by all provisions prescribed in the order forms submitted by you for the purchase of any art works from the Sites. In particular, you warrant that all information that you submit will be true and accurate (including without limitation your credit card number and expiry date), and you agree to pay all charges plus all applicable taxes for the purchases made by you.

We are not liable in any circumstances for special, indirect or consequential loss or any damages whatsoever resulting from loss of use, loss of data or loss of revenues or profits, whether in an action of contract, negligence or otherwise, arising out of or in connection with your use of Our Web Site or the purchase of Goods.

In any claim against us our liability is limited to the value of the goods you have purchased in the contract which is the subject of the dispute.

No third party is authorized to give a link on their website to Abstract Indian Art website without prior written approval from Abstract Indian Art authorities.

For all international shipments special handling fees, duties and taxes at destination as applicable will be borne by the buyer over and above the payments made to Abstract Indian Art for the purchase of the art work.

For international shipments and for domestic air cargo shipments an additional fuel surcharge applicable at the time of shipping may vary from the general quote in the proforma invoice as the Fuel Surcharge at the time of purchase may vary from the Fuel Surcharge at the time of shipping. The buyer agrees to pay Abstract Indian Art any such variations in charges as may be applicable at the time of shipping.

Governing Law
This terms and condition shall be governed by and construed in accordance with the law of Republic of India. This terms and condition shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is hereby expressly excluded. All legal proceedings arising out of or in connection with this terms and condition shall be brought solely in India and Buyer expressly submits to the jurisdiction of New Delhi Courts, in the Indian state of Delhi only.
